THE NOTAIRE

In general all real estate transactions go smoothly in France, this is thanks to the notairial system, all buying and selling of property , whether from an estate agent, a Notaire or a private seller must be carried out under the auspices of a notaire.

There is no actual english equivalent to a Notaire however they have been aligned to either a Lawyer or a solicitor. The Notaire deals in all aspects of Law including Civil, Property, Commercial, Company, Fiscal and International law. They are publics officials authorised by the French government to prepare private contracts and it is one of their duties to complete all legal transactions relating to property purchase in France.

Once you have found a property to purchase and have had your offer accepted you will be required to sign a COMPROMIS DE VENTE.You then have a seven day cooling off period in which you may withdraw from the transaction if you so wish without any obligation. If you proceed after this cooling off period you will then be required to pay, to the Notaire only, a deposit cheque of 10% of the property price.

At the time of signing the COMPROMIS DE VENTE you can include certain suspensive clauses re: mortgages, planning consent etc. Consult your notaire for advice about any issues that you may wish to discuss at this time. The notaire will now gather all information and prepare the legal documents necessary for transfer of title of the property, normally six to eight weeks. You will then forward the balance of the property price + notaires fees again to the notaire only.

Once these funds have cleared you will sign the final contract THE ACTE DE VENTE. Once signed the property becomes yours, it is a legal requirement in France that property insurance must be in place and in your name at this time.

COST INVOLVED IN FRENCH PROPERTY PURCHASE

Property Price + Commission+ Notaires Fee + Vat

Property Price: It is very important for you to know the actual price you are paying for the property before all commissions etc are added on to it, otherwise how will you know what the actual property is worth?

Commissions: Like in England when buying with an estate agent, commissions can be variable. However a Notaires Commission called the Negociation , is set and fixed by the French government as follows:

  • Up to 46000 euros - 5% of the purchase price
  • Over 46000 euros - 2.5% of the purchase price

Vat or Tva is 19.6%
This is payable on most fees and commissions
